Can a Power of Attorney Sell a House in Ontario?

Share This Post:

A common question families ask is whether a Power of Attorney can sell a home. The answer is yes in some cases—but only under specific conditions.

When a POA Can Sell Real Estate

A POA may sell a home if:

  • The homeowner is alive
  • The POA document grants authority over property
  • The sale is in the homeowner’s best interest

POAs have legal duties and must keep detailed records.

If authority is unclear, understanding the difference between a Power of Attorney and an executor in Ontario can help clarify next steps.

When a POA Cannot Sell a Home

Once the homeowner passes away, a POA no longer has authority. At that point, responsibility transfers to the executor.

This transition is explained further in executor responsibilities when selling real estate in Ontario.
